Under Thai law it is not possible for non Thai individuals to purchase freehold title to land in Koh Samui (or indeed anywhere in Thailand). Therefore each owner will be granted a 30 year renewable lease which will give security of tenure in perpetuity. This is the tried and trusted way for foreigners to own land in Thailand.
Leases will be granted in the name of an offshore company which will be set up by Sovereign Trust (Hong Kong) Ltd., (see www.SovereignGroup.com) as part of the purchase price. Johnson Stokes & Master (JSM), the largest law firm in Asia and well respected in Thailand, are Samujana's lawyers and are preparing all documentation for the plot owners. This will also include a deed of mutual covenant regarding the rights/obligations of each owner to the others and the Company. Grant Thornton, the international accounting firm have been retained to assist with all accounting. Both JSM and GT, as well as the company's bankers, HSBC, have been involved in the project since inception. Together with Sovereign Trust, the structure will provide an effective way for all purchasers to maximize their investments whether by way of capital increase, rental income or simply security and peace of mind. |
